TERMS AND CONDITIONS HOTEL MICONIA AND SEASIDE HOTEL.

The following document aims to apply to the relationship between the guest/client of Hotel Miconia and SeaSide for pre-booking, reservation, stay and end-of-stay services.
The use of the services presupposes that the customer accepts and validates the conditions and terms imposed by Hotem Miconia and SeaSide. (Which are automatically considered and incorporated into the contract between the client and Hotel, without the written transition being mandatory.)

PRE-BOOKING AND BOOKING
After a customer requests a pre-booking, the Miconia and Sea Side hotel presents the potential customer with a stay proposal and a reservation code, in accordance with the requirements dictated by the customer.
If the customer uses tour operators or internet room reservation portals, the reservation code will be different from the one provided directly by the Hotel, and will be equally valid.
The Hotel further informs that reservation requests made directly to you or through tour operators are not binding and do not oblige you to enter into a contract with the customer. The Hotel reserves the right to refuse to conclude the contract and make a room available at its sole and discretionary discretion.
Hotel Miconia and Sea Side Business Hotel only guarantees the availability of a room in the reserved category and not a specific hotel room.
RESERVATION AND CANCELLATION TYPES
At the Miconia And Sea Side hotel you can make two types of reservations: the guaranteed reservation and the non-refundable two-stage reservation.
The customer will pay the total amount for their stay via credit card or bank deposit, and will have up to 1 month after purchase to change the date or cancel their reservation, as well as request a refund of the amount paid. After 1 month has passed, the establishment will not refund the amount paid, and for changing the date, 10% of the daily package will be charged for carrying out this service subject to availability for the period.

Reservation in two stages: The customer can pay 50% at the time of booking via credit card or bank deposit and 50% at check-in. The two-step reservation cannot be canceled or changed.

ARRIVAL AND DEPARTURE
The Hotel Miconia and Sea Side will provide the customer with a room of the selected category upon arrival from the date of arrival or, if the customer makes the reservation at the Hotel reception, the Hotel Miconia and Sea Side will provide a room depending on the category desired and according to availability at the time, with check-in starting at 1:00 p.m.
Upon arrival at the Hotel, you must immediately pay for the entire stay.
On the departure date, the client must leave the room, leaving it free of people and without any damage by 10:00
In the event that the customer does not leave the room by 10:00 am, a fee corresponding to a one-night stay at the hotel will be automatically charged, with the only right to use the room during that period if the hotel has room availability, otherwise you will have You must still pay the fee and leave the room as soon as possible.

TERMS OF USE
1. The Miconia and Sea Side hotel assumes that only the people indicated in the accommodation reservation will have the right to use the hotel room.
2. It is strictly prohibited not to take care of and respect the hotel spaces.
3. The customer must respect other customers and the rules of good conduct imposed by Hotel Miconia and Sea Side.
4. The customer is not authorized to use the reserved access areas.
5. The customer cannot cook the food brought, whether in the hotel room or in other areas thereof.
6. Children under 14 years of age must be accompanied by adults at all times during their stay.
7. The client is entirely responsible for the goods left at the Miconia And Sea Side Hotel, having the duty to supervise them during their stay. (The Hotel informs that all rooms are equipped with a small safe).
8. Pets are not allowed on hotel premises.

CUSTOMER/GUEST BEHAVIOR

  1. Smoking any tobacco products and/or their derivatives, including electronic cigarettes, is not permitted. In order to ensure that all rules are complied with and for the well-being of all hotel guests, upon check-in you will be asked to sign our accommodation policy.
  2. The hotel is not responsible for any object or document that has not been left in its custody. However, the rooms have a safe for your personal use during your stay.
  3. The Hotel reserves the right to expel customers who are acting in an unfair, offensive and threatening manner towards other customers or employees
  4. It is prohibited to make changes to the organization of space and equipment in rooms and common areas.
  5. It is prohibited to store dangerous items in rooms, such as weapons, ammunition, explosives, flammable materials and psychoactive substances
  6. It is prohibited to sell items in the hotel spaces.
  7. During the stay, it is prohibited to make excessive noise that disturbs the rest of other customers and to engage in behavior considered inappropriate.
  8. Customers must respect quiet hours: 9:00 pm to 7:00 am
  9. It is strictly prohibited not to take care of and respect the hotel spaces.
  10. The customer must respect other customers and the rules of good conduct imposed by Hotel Miconia And Sea Side.
  11. In the event of damage, theft or loss of items belonging to the Miconia and Sea Side hotel, the hotel reserves the right to charge the full value of the damaged/stolen or lost items.

ACCESS TO THE HOTEL ROOM
Hotel Miconia and Sea Side and its staff have the right to enter the hotel room, during the customer's stay, in order to carry out cleaning, repairs and similar work.
7. PRICE OF STAY AND OTHER PRICES
The price of the stay to be paid by the customer constitutes the consideration for providing the use of the hotel room, in the period between arrival and departure.
The total price of the stay will be charged per night, regardless of whether the customer actually made use of the room or spent the night there.
The applicable rates are the agreed prices or the price indicated in the Hotel Miconia and Sea Side price list in force on the date of conclusion of the contract.
The fees and amounts indicated in the terms and in the accommodation contract are all plus VAT, unless expressly stated otherwise.

TERMS OF STAY
The cost of the stay and prices for additional services must be paid in advance when the customer arrives at the hotel, regardless of the billing date.
If the length of stay is not specified, the price of the stay and prices for additional services for each night must be paid in advance by 12pm.
In the case of stays without a specified departure date, failure to pay the price of the stay and additional services under the terms set out in the previous number determines the immediate termination of the contract and immediately obliges the customer to leave the room and hand over the respective key to the Hotel. .
Fees for additional services are identified, for example, with other charges that are not expressly mentioned in the accommodation contract and that form part of the value of the stay.
Hotel Miconia and Sea Side accepts payment in American Dollars, transfers, and Visa, Mastercard and American Express cards. Other payments will only be permitted in exceptional cases, with the specific consent provided by the Hotel.

CLAIMS REGARDING MATERIAL DEFECTS
1. The customer must inspect the hotel room upon arrival and immediately report any defects found at the hotel reception.
2. Any defects that may arise during the stay must be reported to the hotel reception, as soon as customers become aware of them.
3. If it is verified that there is indeed a defect in the customer's room, Hotel Miconia And Sea Side has the right to choose between repairing it and relocating the customer to a room that has at least the same category contracted by the customer.
4. For the purposes mentioned above, only serious defects that are likely to jeopardize the level of service and quality of the Hotel will be considered, and the Hotel is not obliged to take any action if complaints are made that are irrelevant, unreasonable or related to details that do not conflict with the minimum contracted level.
5. If Hotel Miconia end Sea Side does not have the means to repair the relevant defect or replace the customer's room with another of a similar or higher category, the customer may only terminate the contract and receive the amount paid for the room, nothing more may demand from the Hotel in any capacity whatsoever.

LIABILITY ON THE PART OF HOTEL MICONIA AND SEA SIDE.
1. Hotel Miconia and Sea Side will only be responsible for damages or losses to the customer when such facts result from the Hotel's culpable actions.
2. The Hotel reserves the right not to assume any responsibility for loss of data provided by the customer in the case of electronic transmission of payment data and is only responsible to the customer if there is culpable action.
3. The Hotel is not responsible for damages or accidents occurring inside the room or any other area of the hotel, unless it is guaranteed that the Hotel is to blame.
4. Hotel Miconia and Sea Side will not be considered responsible to the customer in case of delay in making the room available if there are valid reasons for not making the room available on time. Valid reasons include, for example, strikes, blockades, natural disasters, accidents in the hotel room itself.
5. In case of delay in making the room available beyond 3pm, the customer may freely terminate the contract without having the right to demand any compensation from the Hotel for any reason whatsoever.
6. The hotel only assumes responsibility for acts carried out by any hotel worker if they are during normal working hours, duly identified and dressed in uniform as a company worker.
7. Hotel Miconia and Sea Side reserves the right not to assume any responsibility for non-compliance with additional obligations
8. The Hotel is not responsible for the act or omission of any other customer, even if it is likely to cause damage or loss to another customer of the Hotel. All acts caused by third parties to Hotel customers are their sole responsibility.
9. The Hotel does not assume responsibility to the Customer for any loss of profits or indirect losses, even if resulting from failure to comply with a main obligation.

NOTIFICATION DUTIES
In the event of theft or damage to property or, in the event of fire, water damage or other damage to the hotel room, the guest must immediately inform hotel staff and do everything possible to assist in resolving the theft or repairing the property. damage caused.

TERMINATION OF THE ACCOMMODATION CONTRACT
1. The Hotel has the right to terminate the accommodation contract if the customer does not make full and timely payment when required or does not provide the required guarantee.
2. Either party may summarily terminate the accommodation contract for just cause.
3. Hotel Miconia and Sea Side will have the right to immediately terminate the accommodation contract for just cause if the customer exhibits any behavior that affects the good coexistence, peace or hygiene of the hotel, particularly if during their stay at the hotel, the customer is under the influence of drugs or alcohol, uses the hotel room for prostitution, acts offensively towards hotel staff or other hotel guests, disturbs the peace of other hotel guests, or, in the past, has made reservations false malicious intent and/or damaged or destroyed the hotel or its facilities.
